Scheduling Order
ORDER. As discussed during the conference, to facilitate the parties' discussions during the upcoming mediation, the settlement demand must be served on or before 7/31/2026. The parties must serve initial disclosures on or before 8/7/2026, and initial document requests and interrogatories on or before 8/14/2026. To the extent that Defendants intend to pursue non-party discovery, they should move forward with it expeditiously and with attention to possible jurisdictional issues. The deadline for filing an amending pleading, adding additional parties or commencing motion practice to amend a pleading or to add a party is 11/13/2026; after this date, no further amendments or joinder will be permitted thereafter unless good cause is shown. A joint discovery status letter is due to the Court on or before 12/4/2026. The parties must note that all discovery depositions must be completed at least 30 days before the close of fact discovery. Fact discovery closes 1/2/2027.
If the parties engage in expert discovery, initial expert disclosures must be served by 1/2/2027, initial expert reports by 1/29/2027, and rebuttal expert reports by 2/26/2027. Expert discovery closes on 4/2/2027. By the same date, the parties must file a joint letter certifying the close of all discovery. Dispositive motion practice must commence on or before 5/7/2027, or the proposed JPTO must be filed on or before 6/4/2027, in accordance with the assigned judge's individual rules.
