ORDER: Before the Court is Defendant's Motion for Leave to Move for Summary Judgment Outside of Time Based on Change in Status of Colorado Law. ECF No. 109 . The Court denies Defendant's request to file an out-of-time summary judgment motion. For all the reasons set forth in Plaintiff's response, ECF No. 111 , and based on the line of authority of which the Court is - and has been - aware, as discussed at recent hearings conducted with the parties, there is no basis to file an out-of-time summary judgment motion.
