PAPERLESS ORDER. THIS CAUSE came before the Court upon the Parties' Notice of Mediation. 30 . The Notice states that the Parties' mediation is scheduled to occur via Zoom. See id. at 1. The Parties submit that there is good cause for remote mediation because "[c]ounsel for both Parties includes out-of-state attorneys[,] Plaintiff resides in Minnesota[,] and Defendant's authorized representative who will be participating in the mediation resides in Oregon." Id. The Parties further submit that "[a]n in-person mediation would thus require the Parties and their counsel to travel from out-of-state to Florida," which they consider "a counterproductive expenditure of resources that would undermine the fundamental purpose of mediation." Id. In its Paperless Order of Referral to Mediation, the Court emphasized that the "physical presence of counsel and each party with full authority to enter in a full and complete compromise and settlement is mandatory," and that the "mediation shall take place in person absent good cause shown by the parties." See (ECF No. 16). Here, the Court does not find good cause for remote mediation. Accordingly, the Notice 30 is STRICKEN as it does not comply with the Court's Paperless Order of Referral to Mediation (ECF No. 16). The Parties shall file a compliant Notice of Scheduling Mediation on or before November 4, 2026. Signed by Judge K. Michael Moore on 10/8/2026. (mgm)
