Status Conference
Minutes of proceedings [non-document] before Chief District Judge Sara Lioi. On June 23, 2026, the Court conducted a telephonic status conference. Attorneys Nick LaCava, Georgos Kontos, Phillip Sarnowski, and Robert Boroff participated. The Court discussed with counsel the parties' stipulated dismissal of defendant Schneider Logistics, Inc., and the Court advised that it will enter an order today dismissing Schneider Logistics Inc. from this action. The parties advised that fact discovery is complete. As to expert discovery, the plaintiffs' counsel indicated that he is working with medical providers to obtain treatment records for plaintiff, Richard Deyell, and may have to seek leave to extend the Court's discovery deadline for a short time if they are unable to obtain these records by the deadline. Counsel for plaintiff American Petrolog advised that they anticipate moving for summary judgment in accordance with the Court's Amended CMPTO. The Court encouraged counsel for the remaining parties to engage in good faith settlement discussions before investing time and resources in expert discovery and motion practice. Toward that end, plaintiffs' counsel agreed to submit an initial demand to defendant American Petrolog by June 30, 2026, after which counsel and the parties shall confer about settlement. Should the parties desire the Court's assistance with scheduling or facilitating mediation, counsel may so indicate in a status report, or by calling chambers directly. (Court Reporter: None.)
