NOTICE OF E-FILED CALENDAR re: 65 Joint MOTION for For Approval of Settlement and Dismissal of Claims With Prejudice Order. THIS IS THE ONLY NOTICE COUNSEL/THE PARTIES WILL RECEIVE. Motion Hearing set for 7/15/2026 at 9:00 AM in Remote Setting before Judge Thomas O. Farrish. The parties are directed to file a copy of the proposed settlement agreement on the docket on or before July 8, 2026. If either party contends that the agreement should be sealed from public view, they may docket it provisionally under seal accompanied by a motion to seal, but they should note that "a judicially approved FLSA settlement agreement is a judicial document entitled to the strong presumption of public access, which requires a substantial showing to overcome." Olano v. Designs by RJR, Ltd., No. 17-cv-5703, 2017 WL 4460771, at *2 (S.D.N.Y. Oct. 6, 2017). Any motion to seal should therefore not be perfunctory, but should explain in detail why a document typically subject to a strong presumption of access should be sealed in this instance.Before the hearing, counsel may wish to review Faniel v. PAFY, Inc., No. 3:20-cv-387 (VLB) (TOF), 2022 WL 1212813 (D. Conn. Feb. 14, 2022), for a preview of the questions the Court will likely ask. The Court is familiar with the settlement from having presided over the mediation, and it therefore expects this hearing to be brief. But counsel should nevertheless come prepared for a discussion, if only a brief one, of the "Wolinsky factors" and scope-of-release issues addressed in that case.
