ORDER TO SHOW CAUSE: New York and federal law each allow a corporation to be served by delivering the summons and complaint to "an officer, director, managing or general agent... or to any other agent authorized by appointment or by law to receive service." Mulligan Funding LLC v. Tommy Interior Contracting Corp., 741 F. Supp. 3d 1, 10 (E.D.N.Y. 2024) (quoting N.Y. C.P.L.R. &sect 311(a)(1)); see also Fed. R. Civ. P. 4(h)(1)(B). Plaintiff's affidavit of service 8 indicates that service was made on "Jane Doe Name Refused" whom the process server knew to be "the Administrator" of the defendant corporation, "an authorized person to accept service of process." ECF No. 8 . No factual basis for this conclusion is provided. Plaintiff is directed to show cause by September 30, 2026 why service was proper and how the process server could have known that the person who refused to identify herself was authorized to accept service for defendant. In alternative, Plaintiff may re-serve Defendant and file proof of service by the same date, September 30, 2026. Ordered by Magistrate Judge Clay H. Kaminsky on 9/10/2026. (TJT)
