Order on Motion to Withdraw as Attorney
PAPERLESS ORDER denying without prejudice 18 attorney Joshua Feygin's renewed motion to withdraw from his representation of the Plaintiff. The Court previously 15 denied Feygin's motion to withdraw, noting that he had failed to indicate what the Plaintiff's position is regarding the requested relief. In Feygin's renewed motion, he provides information on the Plaintiff's position as to the withdrawal of another attorney, but, puzzlingly, omits any mention of the Plaintiff's position on his own withdrawal: "Plaintiff responded and informed Attorney Newhart that he was not opposed to Attorney Newhart withdrawing from the case." (ECF No. 18, 2.) Now that attorney Newhart and another attorney have been terminated from representing the Plaintiff, leaving Feygin as the Plaintiff's only remaining attorney, it is even more important for Feygin to confer with his client and advise the Court as to his client's position on Feygin's withdrawal. Feygin is cautioned, should he attempt to withdraw a third time, that his continued failure to properly support the relief he requests may subject him to sanctions. Signed by Senior Judge Robert N.
