ORDER by Judge Mustafa T. Kasubhai: Plaintiff filed a Renewed Emergency Motion for Temporary Restraining Order and Preliminary Injunction, requesting expedited relief on the same day. ECF No. 31 . A court may only issue a temporary restraining order without affording the adverse party a reasonable opportunity to respond if "specific facts in an affidavit or a verified complaint clearly show that immediate and irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition." Fed. R. Civ. P. 65(b)(1). A party seeking a temporary restraining order must show (1) he or she is likely to succeed on the merits; (2) he or she is likely to suffer irreparable harm in the absence of preliminary relief; (3) the balance of equities tips in his or her favor; and (4) that an injunction is in the public interest. Winter v. Nat. Res. Defense Council, Inc., 555 U.S. 7, 20 (2008); see Stuhlbarg Int'l Sales Co. v. John D. Brush & Co., 240 F.3d 832, 839 n.7 (9th Cir. 2001). At this stage, there is insufficient evidence to establish Plaintiff is likely to succeed on the claims he raises in his Motion or to clearly show that Plaintiff will suffer an immediate injury before Defendants have a reasonable opportunity to respond. Further record development is necessary to determine whether a renewed or modified preliminary injunction is appropriate. Plaintiff's Motion for an Emergency Temporary Restraining Order (ECF No. 31 ) is therefore DENIED, and the Court shall set a briefing schedule for Plaintiff's Motion for a Preliminary Injunction. Defendants are ordered to respond to Plaintiff's Motion by July 22, 2026. Plaintiff's Reply is due August 5, 2026. (Deposited in outgoing mail to pro se party on 7/8/2026.) (bd)
