ORDER by Magistrate Judge Kevin R. Sweazea. On May 27, 2026, the Court entered a text order stating that the parties had contacted Chambers to announce a settlement, and directing the parties to file closing documents, or seek an extension, by June 30, 2026. Dkt. # 188. Plaintiffs then filed an unopposed motion for an extension of time to file closing documents until August 15, 2026, which the Court granted. Dkt. # 191. Plaintiffs then filed a second unopposed motion for an extension of time to file closing documents until September 14, 2026, which the Court also granted. Dkt. # 193. Since then, two additional motions for extensions of time to file closing documents have been filed, but they have been motions filed jointly by Plaintiffs and Defendants Berning and Carson, requesting an extension to file closing papers as to those two defendants only. Dkt. ## 194, 196. While the two most recent motions state that the remaining defendants do not oppose the request for an extension for closing papers as to Defendants Berning and Carson, no mention is made of the deadline for filing closing documents for those remaining defendants, for which no extension has been sought and which expired September 14, 2026. Finding good cause and noting the agreement of the parties, the Court GRANTS 196 Joint MOTION for Extension of Time to File Closing Documents filed by Joseph Berning and Carole Carson, and extends the deadline for closing papers to be filed as to those two defendants to October 5, 2026. In addition, if closing papers are not filed as to the remaining defendants by October 5, 2026, the Court orders Plaintiffs and those defendants to file a joint notice on or before that date reporting on the status of their settlement and proposing an extended deadline by which closing papers will be filed as to those remaining defendants.
