OPINION AND ORDER re: 14 MOTION to Dismiss Plaintiffs' Complaint. filed by TD Bank Group, TD Bank, N.A. For the foregoing reasons, TD Bank's motion to dismiss is GRANTED in part and DENIED in part, and TD Bank's m otion to strike is GRANTED in part and DENIED in part. The motion to dismiss is GRANTED as to K. Wong, Su, and Louie's Title VII claims and as to Plaintiffs' Title VII, NYCHRL, and NYSHRL claims to the extent those claims rely on a theory of disparate impact. The motion is denied in all other respects. The motion to strike is granted as to the NYSHRL and NYCHRL class claims to the extent those claims are brought on behalf of people who do or did not live or work in New York State (f or purposes of the NYSHRL) or New York City (for purposes of the NYCHRL). The motion to strike is denied in all other respects. Defendants shall file an answer to the remaining claims within 14 days of the date of this opinion and order. The Cler k of Court is directed to close the motion at Docket Number 14. Counsel for all parties are directed to appear telephonically for an initial pretrial conference with the Court on September 21, 2026 at 4:00 p.m. Counsel should call (855) 244-8681 at the scheduled time. The attendee ID number is 231 2828 7066 ##. Counsel who appear at the pretrial conference must be authorized to negotiate terms of settlement. Members of the public may join but are instructed to place their phones on mute. Counsel are further directed to use the Court's Civil Case Management Plan and Scheduling Order form (the "Form") to jointly prepare a detailed written proposed schedule for any motions and discovery. The parties shall submit a copy of the completed Form by filing on ECF at least seven calendar days prior to the date of the conference.
