Motion Hearing Order on Motion for Summary Judgment
Minute Entry & Order for proceedings held before Judge Natasha C. Merle: Telephone Motion Hearing held on 8/27/2026 re 144 MOTION for Summary Judgment, 139 MOTION for Summary Judgment. Appearances: Yoav Griver, Kevin Badkhshan appeared on behalf of plaintiff; and Gerard Dunne appeared on behalf of defendants Brooklyn Armed Forces, et al. Case called. Discussions held. The Court converted defendant BAF's motion for judgment on the pleadings 139 to a motion for summary judgment. Defendants' motions for summary judgment 139 , 144 were orally denied in part and granted in part, for the reasons stated on the record. The Court denied the motions with respect to plaintiff's Lanham Act, patent infringement, and New York General Business Law § 349 claims and granted the motions as to plaintiff's NJCFA claim. By September 3, 2026, the parties shall file a letter advising the Court whether they believe a settlement conference would be fruitful at this time. (Court Reporter Nicole Sesta.) (AG)
