ORDER. On January 30, 2026, this Court dismissed Plaintiffs' action, which sought to compel readjudication of a visa application made outside the United States. ECF No. 25 . On March 18, 2026, Plaintiffs appealed this Court's dismissal of their complaint. See ECF No. 29 . In a motion to dismiss the appeal, Defendants represented that, on March 30, 2026, the visa application in question was readjudicated and refused under 8 U.S.C. § 1182(f). See Mot. to Dismiss Appeal, Second Circuit Case No. 26-676, Dkt. No. 26.1. The Court of Appeals recently granted Defendants' motion to dismiss the appeal as moot, vacated this Court's judgment, and issued an order to this Court to dismiss the action as moot. See Order, Case No. 26-676, Dkt. No. 48.1. Accordingly, the judgment at ECF No. 26 is VACATED and this action is DISMISSED as moot. See United States v. Munsingwear, Inc. , 340 U.S. 36, 3941 (1950); Westchester v. U.S. Dept of Hous. & Urb. Dev., 778 F.3d 412, 416-17 (2d Cir. 2015). Signed by Judge Sarala V. Nagala on 8/13/26. (JH)
