Court addressed 33 Notice of Settlement and the parties request for the court to retain jurisdiction to enforce settlement as stated on the record. Neer Lerner addressed the court and stated that there is no need for the court to retain jurisdiction as stated on the record. Mr. Tolson addressed the court. After discussion, for reasons stated at today's hearing, Court will sign 35 Stipulation of Dismissal. Court is not retaining jurisdiction as to enforcement of settlement as stated on the record. MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for District Judge Dale A. Drozd on 8/31/2026: On 4/16/2026, the parties filed a 35 Stipulation to voluntarily dismiss this action pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii). Therein, the parties stipulate that the court will retain jurisdiction to enforce the terms of the Settlement Agreement. On 8/31/2026, the court held a status conference at which counsel for all parties were present, and counsel for plaintiff and counsel for defendant Home Depot, Inc. represented to the court that they were no longer requesting that the court retain jurisdiction to enforce the terms of the Settlement Agreement. Pursuant to the parties' stipulation, this action is DISMISSED with prejudice. However, the court declines to retain jurisdiction to enforce the terms of the Settlement Agreement. All pending deadlines and hearing dates in this action, if any, are VACATED. The Clerk of the Court is directed to CLOSE this case. Civil Case Terminated. CASE CLOSED. (Deputy Clerk PAB)
