This Court's Finding and Recommendation 37 (adopted in full by Order 42 ) explains the Eitel v. McCool, 728 F.2d 1470, 1471-72 (9th Cir. 1999) analysis that must be complied with in order for the Court to enter a default judgment against those two defendants (see specifically explanation beginning on p. 6 of the Findings and Recommendation 37 ). ORDER - The Court GRANTS the parties' Joint Motion for Extension of Discovery & PTO Deadlines (ECF 143 ) as follows: (1) Discovery is to be completed not later than November 30, 2026; (2) Dispositive motions are due not later than January 4, 2027; (3) Expert disclosures are due 30 days after the Court's ruling on dispositive motions; (4) Rebuttal expert disclosures are due 30 days after expert disclosures; and (5) Expert depositions to be completed 30 days after rebuttal disclosures.
