ENDORSED ORDER: Plaintiff has filed a "Notice of Resolution" stating that this action "has been resolved." (Doc. # 22). The Court notes that, in the Eleventh Circuit, any settlement reached between the parties in an FLSA action is subject to judicial scrutiny of the terms of the settlement agreement. See Lynn's Food Stores, Inc. v. United States, 679 F.2d 1350, 1353 (11th Cir. 1982) ("When employees bring a private action for back wages under the FLSA, and present to the district court a proposed settlement, the district court may enter a stipulated judgment after scrutinizing the settlement for fairness."). Accordingly, judicial review of the circumstances surrounding Plaintiff's decision to dismiss her FLSA claims is required. Seliem v. Islamic Soc'y of Tampa Bay Area, Inc., No. 8:18-cv-1590-VMC-AEP, 2018 WL 4925687, at *2 (M.D. Fla. Oct. 2, 2018). Here, Plaintiff has not informed the Court as to the basis of the parties' resolution of this action. Without more information, the Court cannot yet determine whether the parties have reached "a fair and reasonable resolution" of Plaintiff's FLSA claims. Lynn's Food Stores, 679 F.2d at 1355. Therefore, Plaintiff must file a motion for Court approval of the parties' settlement agreement by July 21, 2026. The motion should include information concerning the amount to be paid to Plaintiff (including liquidated damages) for alleged FLSA violations. Signed by Judge Virginia M.
