   Order on Motion for Default Judgment

   ORDER VACATING ENTRY OF DEFAULT. Defendant Stamford Golf Authority ("SGA") has filed an appearance and asks the court to deny Plaintiff's Motion for Default Judgment 52 . The court entered a default as to SGA on August 6, 2026 after SGA failed to respond to the Complaint. ECF No. 39 . A "court may set aside an entry of default for good cause." Fed. R. Civ. P. 55(c). In assessing whether good cause exists to vacate entry of default, the Second Circuit has counseled courts to consider "(1) whether the default was willful; (2) whether the moving party has presented a meritorious defense; and (3) whether setting aside the default would prejudice the party for whom default was awarded." State Farm Mut. Auto. Ins. Co. v. Cohan, 409 F. App'x 453, 455 (2d Cir. 2011) (summary order). SGA asserts it first learned of this action on August 6, 2026 when a server handed the Summons and Amended Complaint to its Executive Director. As it appears the default was not willful and Plaintiff will not be prejudiced given the early stages of this case, the court vacates the entry of default. SGA shall respond to the complaint on or before September 28, 2026. Plaintiff's Motion for Default Judgment as to Stamford Golf Authority 52 is denied. Signed by Judge Sarah F. Russell on 8/19/26.
