MINUTE entry before the Honorable Nancy L. Maldonado: The Court had instructed Appellant Wiggins to serve his motion for leave to appeal on Appellee as well as the Court's order setting a briefing schedule 7 , but it is not clear notice was ever served and Appellee did not appear in this action nor respond to the motion for leave to appeal. Upon review of the Bankruptcy Court docket, however, it appears that Wiggins filed a notice on February 20, 2024 notifying the Bankruptcy Court that he was withdrawing his motion for leave to appeal. This appeal thus appears to have become moot, though it would have been appropriate for Wiggins to also file a notice in this Court of the termination of his appeal. In any event, Appellant's motion for leave to appeal 2 is denied as moot, based on his statement to the Bankruptcy Court that he is withdrawing his appeal. Civil case terminated.
