Order
ORDER: Accordingly, the parties are instructed to file their completed settlement agreement along with a joint letter regarding the fairness of the settlement agreement on or before October 16, 2026, in accordance with the FLSA and Second Circuit la w. See, e.g., Cheeks v. Freeport Pancake House, 796 F. 3d 199 (2d Cir. 2015). The parties may consent to the jurisdiction of Magistrate Judge Gary Stein in reviewing their Cheeks briefing. Indeed, this option may be preferable in light of Judge Stein 's familiarity with recent developments in the case, but is not required. Should the parties wish for Judge Stein to review their Cheeks briefing, the Court reminds the parties to indicate their consent to proceed before a magistrate judge in the form attached to this Order. The Clerk of Court is directed to terminate all pending motions and adjourn all remaining dates. (Signed by Judge Katherine Polk Failla on 9/16/2026) (rro)
