ORDER. The Court heard counsel on the question of vacation. For the reasons stated on the record, in sum, that the record does not show that Defendant Coinband, LLC willfully failed to appear, particularly given the initial service and that Defendants responded to this action after the alternate service; the record does not show any cognizable prejudice to Plaintiff by vacating the default; and that Defendant Coinbound, LLC has answered the complaint and raised meritorious defenses at ECF No. 27 , including a lack of personal jurisdiction which would affect the validity of any default, the Court vacates the default certificate at ECF No. 21 .
The parties must serve initial disclosures on or before 9/17/2026. Plaintiff's initial disclosures must include a damages calculation. The parties must serve initial document requests and interrogatories on or before 10/15/2026. A joint discovery status letter is due to the Court on or before 10/29/2026. The letter must include the parties' proposal as to next steps in this action as well as their progress with settlement discussions. If the parties would like to augment their settlement discussions with assistance from the Court-annexed mediation program, they may request a referral to the program in their 10/29/2026 letter or at any time by filing a request on ECF.
