SCHEDULING NOTICE TEXT ENTRY ONLY by Judge Anne Hwang. NOTICE AND ORDER TO ALL PARTIES. Counsel are hereby notified that the Jury Trial in this matter is scheduled for October 20, 2026, with the Final Pretrial Conference set for October 1, 2026. Dkt. No. 62 . The deadline for the parties to file all trial documents was September 17, 2026. Id. Neither party has filed pre-trial documents. The parties have been repeatedly admonished for their failure to properly comply with the Courts orders regarding Final Pretrial Conference documents. Dkt. Nos. 47 , 57 . Because the Final Pretrial Conference cannot proceed as scheduled, the Court vacates the Final Pretrial Conference set for October 1, 2026, and orders the parties to meet and confer and file by 5:00pm on SEPTEMBER 23, 2026, either: (1) all required Final Pretrial Conference documents, or (2) a request for dismissal or proposed judgment. Failure to adequately respond to this Order may result, without further warning, in the Court dismissing this action. The Court additionally issues an order to show cause re why the Court should not impose monetary sanctions in the amount of $2,000 for the parties continued failure to abide by the Courts orders. Although the parties previously discussed a potential settlement of this action, no notice of settlement has been filed nor any proposed judgment or dismissal. A written response to the OSC shall also be filed by September 23, 2026. Failure to properly or timely respond will result in the imposition of monetary sanctions without further notice or order of the Court. IT IS SO ORDERED.
