(IN CHAMBERS) ORDER by Magistrate Judge Margo A. Rocconi. Plaintiff has moved to remand this action to state court, arguing, among other things, that diversity jurisdiction is lacking because both Plaintiff and Defendant Christian Rios are citizens of California. Dkt. 15 at 3. In opposition, Defendant UPS contends that Defendant Rios is an unserved sham defendant. Dkt. 19 at 6. Defendant now appears to acknowledge, however, that counsel accepted service on behalf of Rios. Dkts. 31 , 32 . Accordingly, Defendant UPS is hereby ORDERED TO SHOW CAUSE why this case should not be remanded. Defendant UPS shall file a brief, not to exceed five pages, addressing this issue no later than September 4, 2026. Plaintiff may file a cross-brief, not to exceed five pages, no later than September 4, 2026. Defendants failure to file the required brief may be deemed as consent to remand.
