REPORT & RECOMMENDATION TO THE HON. ANDREW L. CARTER re: 40 MOTION to Strike Document No. 9 Answer, Affirmative Defenses, and Counterclaim of Defendant New York Helicopter Charter, Inc.. filed by PHI Aviation, LLC. Here, Defendant is a corporation, not a natural person. Defendant's counsel withdrew on October 27, 2025, after representing that his client intended to abandon its defenses and counterclaims, no attorney has subsequently appeared for Defendant, and Defendant has made no response to Plaintiff's motion to strike. Accordingly, I respectfully recommend that Plaintiff's motion to strike Defendant's answer and dismiss Defendant's counterclaims be GRANTED, and a default judgment be ENTERED against Defendant. Plaintiff is directed to serve a copy of this Order on Defendant by mail at its last known address, by email, and upon the Secretary of State for the State of New York, and to file proof of such service no later than January 23, 2026.
