TEXT ORDER: Plaintiff has 53 moved for leave to respond to Defendant Killeen's 45 Motion to Deem Admitted Defendants' First Set of Request for Admission. Although Plaintiff's response comes a day late, the Court finds good cause to accept the filing. Accordingly, the Court will treat 53 as Plaintiff's opposition to Defendant's 45 motion. That said, Plaintiff's 53 response raises two new issues. First, Plaintiff argues that the RFAs in dispute were emailed to opposing counsel and therefore not properly served. Second, Plaintiff argues that deeming the RFAs admitted would be inappropriate because Plaintiff subsequently testified at his deposition on the same subjects. Accordingly, Defendant Killeen is ORDERED to briefly respond to those two points. Killeen's response should be filed on the docket no later than July 16, 2026. Entered by Magistrate Judge Ronald L.
