MEMORANDUM Opinion and Order: Kristen Dumke's motion for summary judgment 35 is granted. The Fund's motion for summary judgment 30 is denied. The Fund is ordered to qualify Kristen's DRO and remit to her the benefits to which she is entitled. The remaining state-law claims are dismissed without prejudice to renewal in state court. Because the court makes its ruling in part based on arguments not raised by the parties, the court will delay entry of judgment for 14 days; the parties are invited to identify errors in the court's reasoning within 14 days. See FED. R. CIV. P. 56(f) (empowering a district court to grant summary judgment "on grounds not raised by a party" after "giving notice and a reasonable time to respond"). [See attached Memorandum Opinion and Order.] Signed by the Honorable Rebecca R. Pallmeyer on 7/13/2026. Mailed notice. (cp, )
