Plaintiffs are granted summary judgment as to liability on their federal and state securities fraud claims, and Sefcik is granted summary judgment as to liability on his breach of contract claim. Cravey is granted summary judgment in his favor on Plaintiff's federal RICO and state UPUAA claims. Sefcik should inform the court within thirty days as to whether he intends to proceed on a breach of contract claim or a rescission claim.
