MINUTE ORDER. The motion for leave 15 is DENIED. Plaintiff did not file a timely jury demand. Under Fed. R. Civ. P. 38(d), "A party waives a jury trial unless its demand is properly served and filed." The Court's discretion to allow an untimely demand is narrow and an "untimely request for a jury trial must be denied unless some cause beyond mere inadvertence is shown." Pacific Fisheries Corp. v. HIH Cas. & Gen. Ins., Ltd., 239 F.3d 1000, 1002 (9th Cir. 2001). The facts presented by Plaintiff do not establish a cause beyond inadvertence. This case will proceed as a bench trial.
