For the reasons set forth above, Plaintiffs' motion for reconsideration is DENIED. Defendant's motion for summary judgment is GRANTED. Consequently, Plaintiffs' cross-motion for summary judgment is DENIED; Plaintiffs' motion for class certification is DENIED AS MOOT. As a result, there are no longer any live claims. The Clerk of Court is respectfully directed to close Dkt. Nos. 728, 732, 736, and 737. The parties are directed to meet and confer and to propose a form of final judgment to be entered in this case.
