ORDER: Per DE 108 at 1, "Plaintiff has initiated settlement discussions with certain Defendants. Those discussions are ongoing. Plaintiff remains willing to explore resolution with other Defendants where appropriate." It is hereby ORDERED that the parties submit to the undersigneds chambers email (dunst_chambers@nyed.uscourts.gov) by 9/14/2026 ex parte letters (limited to three pages) regarding the status of settlement discussions. See Individual Practice Rule V ("[T]he Court has an affirmative obligation to vigorously explore efforts to reduce litigation costs through settlement. See In re Tobacco Litig., 192 F.R.D. 90, 95 (E.D.N.Y. 2000) (describing the Court's 'duty to take affirmative action assisting the parties in all possible settlement options')."). Given the large number of Defendants--currently 14, by the Court's count--only those Defendants who have engaged in substantive settlement discussions with Plaintiff should submit an ex parte letter (and should endeavor to make those letters as succinct as possible). Plaintiff's ex parte letter should be similarly concise and must identify each Defendant with which Plaintiff has engaged in substantive settlement discussions. Ordered by Magistrate Judge Lee G.
