ORDER RE JOINT STUPILATION RE ELIZONDO ADOPTION OF HOWSE FOURTH AMENDED COMPLAINT AND APPLICABILITY OFASSOCIATED RULINGS [DKT. NO. 439 ] by Judge Maame Ewusi-Mensah Frimpong. The Court, having considered the parties Stipulation and finding good cause therefor, hereby GRANTS the Stipulation and ORDERS as follows: Elizondo Plaintiffs shall be said to have adopted the claims and allegations set forth in the Fourth Amended Complaint filed in the Stephen Howse, et al. v. Chiquita Canyon, LLC, at al. (Dkt. No. 100), and any subsequent amendments thereto, in lieu of filing a separate amended complaint with different or additional claims or allegations; and Elizondo Plaintiffs shall be bound by all prior and subsequent rulings related to the Howse Fourth Amended Complaint.
