Minute Order Order on Discovery Plan and Scheduling Order
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Brenda Weksler on 9/10/2026. Before this Court is parties' proposed Discovery Plan and Scheduling Order ("DPSO"). Although parties acknowledge that the standard discovery period under Local Rule 26-1 is 180 days from the time the first Defendant answers or otherwise appears, the DPSO calculates the discovery cut-off date from the date briefing was completed for the last appearing Defendant's motion to dismiss. Accordingly, the DPSO does not set deadlines within those specified in LR 26-1 and requests special scheduling without specifying that such special scheduling is requested and without providing reasons as to why longer or different time periods should apply to the case. The DPSO is DENIED without prejudice. Parties' amended joint DPSO is due by 9/24/2026. (no image attached) (Copies have been distributed pursuant to the NEF - KNH)
