MEMORANDUM OPINION AND ORDER: Because Justice has stated a plausible Title IX deliberate-indifference claim under both post-reporting and heightened-risk theories, the Court denies Texas Tech's motion to dismiss under Rule 12(b)(6) (Dkt. No. 6). In doing so, however, the Court does not express any opinion regarding the strength of Justices claims. Rather, the Court concludes-as it must at this stage of the litigation- that Justice's allegations, when assumed true and viewed most favorably, state a plausible claim for relief. Accordingly, the Court denies Texas Techs motion to dismiss (Dkt. No. 6). (Ordered by Judge James Wesley Hendrix on 9/22/2026) (bmh)
