TEXT ORDER - The Court is in receipt of Plaintiff OxyChem NY/ERH's request for leave to file a Motion to Consolidate a related action, BASF Catalysts LLC v. Occidental Chemical Corp,, 26-cv-1226 (MCA), into this stayed action, as well as Defendants' opposition. (ECF 2435 , 2437 , 2441 ). Another OxyChem entity has moved to dismiss the BASF Catalysts action in its entirety under Rules 12(b)(1), 12(b)(6), and 19 of the Federal Rules of Civil Procedure. The Court finds that the proposed Motion to Consolidate is premature prior to resolution of the pending Motion to Dismiss in BASF Catalysts, and Plaintiff's application is therefore denied without prejudice. TEXT ORDER: In light of the circumstances described in Defendants' August 12, 2026 letter, their request for an extension of the deadline to file the proposed final pretrial order is GRANTED. However, the Court notes that the original deadline to file that proposed order was July 3, 2026, which the Court set after a settlement conference on April 30, 2026. The parties have had fifteen weeks so far to complete the final pretrial order. Therefore, the proposed final pretrial order shall be filed no later than August 28, 2026. No further extensions will be granted, absent emergent circumstances. The August 19, 2026 final pretrial conference is VACATED and will now proceed on September 9, 2026, at 2:00 p.m., in Courtroom 2D in the Martin Luther King Courthouse, 50 Walnut Street, in Newark.
