Scheduling Order
SCHEDULING ORDER: The Court is in receipt of the letters at ECF Nos. 72 and 73 reporting that Plaintiff has failed to comply with the Court's Orders issued during the 7/9/2026 conference. Plaintiff has not responded to these letters. The Court will hold an in-person conference on 9/2/2026 at 12:00 PM in Courtroom 13A South. The Court has allocated a half hour for this conference. Plaintiff's counsel must be prepared to explain the seeming noncompliance with the Court's Orders. Counsel must be prepared to establish a final expedited discovery schedule.

Status Report Order
ORDER. All fact discovery must be concluded by 9/30/2026. The Court notes that this deadline is dependent upon the parties receiving an expeditious response from the various government agencies expected to produce the records discussed on the record. If such records are not timely received, the parties may ask the Court for an extension prior to conducting depositions. If Plaintiff is already in possession of the records, Plaintiff's counsel is encouraged to produce them as soon as possible.
By 9/24/2026, the parties must submit a joint letter to inform the Court whether they plan to engage in expert discovery. If the parties do so, the Court will set a schedule of 90 days to complete expert discovery. Dispositive motion practice must begin 30 days after the close of expert discovery, or the JPTO must be filed within 60 days thereafter. If the parties do not engage in expert discovery, dispositive motion practice must begin 10/30/2026.
As discussed on the record, Plaintiff's counsel has expressed an interest in mediation. Defendants' counsel will timely investigate whether his clients are likewise interested in mediation. The parties may request such a referral to the program at any time by filing a joint request on ECF.
