SCHEDULING ORDER: 1. The following deadlines shall be observed in this action: a. Parties exchange information Rule 26(a)(1) by 10/9/2026. Disclosures need not be filed in Court Record. b. Pltf TO AND INCLUDING 1/15/2027 to file motions to join additional parties or amend pleadings. Dft TO AND INCLUDING 1/30/2027. c. Rule 26(a)(2) reports from expert trial witnesses due: i. Both parties on respective affirmative claims by 5/1/2027; ii. Rebuttal claims reports by 7/1/2027. d. Parties make any supplements to expert's disclosures w/in 14 days of expert's deposition. e. All discovery by 31/2027. f. Dispositive & any Daubert motions NLT 6/1/2027 w/response & reply time per Local Rule 7.1(c). 2. No motions to compel or any other motions relating to discovery dispute shall be filed unless all counsel involved have conferred. 3. By virtue of 12/1/2000 amendment of Fed.R.Civ.P. 5(d), the parties shall observe the following directives regarding the filing of discovery materials. a. Rule 26(a)(I) b. Portions of any discovery depositions cited in any motion, shall be filed of record in this case. 4. No extensions of the deadlines set in this order, shall be granted unless appropriate motion is filed. 5. TELEPHONIC PRETRIAL CONFERENCE set for 11/4/2027 at 01:00 PM in LEXINGTON before Judge Karen K. Caldwell. Separate Order w/call info will be entered prior to PTC. 6. >JURY TRIAL set for 11/15/2027 at 09:00 AM in LEXINGTON before Judge Karen K. Caldwell. Counsel should be present by 8:30 a.m. 3 days set aside for Trial. 7. Pursuant to 28 U.S.C. §636(b)(1)(A), this matter is referred to the Magistrate Judge. Pretrial Order
PRETRIAL ORDER: 1. NLT 21 days before the PTC, counsel file the following: a. a list of witnesses & exhibits; b. appropriate motions in limine; c. transcript of all evidentiary depositions to be used at trial; d. pretrial memo brief containing succinct statement of the facts of the case, issues of fact & issues of law; 2. NLT 14 days before the PTC, parties file: a. written objections b. responses to other party's motion in limine; c. responses to other party's motion for ruling on any objection; 3. At the PTC, counsel for parties shall be prepared to: a. discuss & make possible stipulations of admissibility or threshold foundation requirements for admissibility of exhibits, including authenticity; b. disclose demonstrative or summary exhibits intended for use at trial; c. discuss possibility of settlement; & e. advise Court of anticipated technological issues that may arise at trial. 4.
