  1. Order | Filed: September 15, 2026 | Entered: September 15, 2026 Padilla Martinez v. Alta Material Handling et al

Personal Inj. Prod. Liability | New York Southern

    Order on Motion for Conference

ORDER granting in part and denying in part 67 Letter Motion for Conference. Application GRANTED IN PART and DENIED IN PART. The deadline for amended pleadings is extended nunc pro tunc until September 29, 2026. The Court will not accept piecemeal amendments as contemplated by the stipulation attached to Plaintiff's motion. (See ECF No. 67, at PDF p. 4.) If Defendants do not consent to Plaintiff filing an amended pleading, Plaintiff shall file a motion to amend by the extended deadline. Any motion shall attach a redline of the proposed amended pleading, which, as the Court previously indicated, must plead the citizenship of all the members of the defendant LLC. (See Order, ECF No. 66.) The Court does not require premotion conferences and does not find that a conference would be useful here. The parties are reminded that the standard for amendment under Rule 15(a) is a liberal one: "[t]he court should freely give leave [to amend] when justice so requires." Fed. R. Civ. P. 15(a)(2). Thus, "[i]n the absence of any apparent or declared reason-such as undue delay, bad faith or dilatory motive on the part of the movant, repeated failure to cure deficiencies by amendments previously allowed, undue prejudice to the opposing party by virtue of allowance of the amendment, futility of amendment, etc.-the leave sought should, as the rules require, be 'freely given.'" Molo Design, Ltd. v. Chanel, Inc., 21-CV-01578 (DEH), 2024 WL 2982924, at *2 (S.D.N.Y. June 12, 2024) (quoting Williams v. Citigroup Inc., 659 F.3d 208, 213-14 (2d Cir. 2011)). The parties also are reminded that the current deadline for the completion of fact discovery is September 30, 2026 and any further request for an extension (see Mem. End., ECF No. 64) shall be made in advance of that deadline. SO ORDERED. (Signed by Magistrate Judge Stewart D. Aaron on 9/15/2026) (vfr)
