MEMORANDUM DECISION AND ORDER - BMO Bank N.A.'s Motion for Default Judgment (Dkt. 7 ) is GRANTED IN PART. Judgment shall be entered in favor of BMO Bank N.A. and against Casey Martinez Trucking, LLC and Casey Martinez, jointly and severally, on BMO's contractual claims in the amount of $169,754.73, plus contractual interest accruing at $64.40 per day from September 10, 2026, through the date of judgment. BMO Bank N.A. is entitled to possession of the Tractor. Casey Martinez Trucking, LLC shall immediately surrender the Tractor to BMO Bank N.A. Any net proceeds BMO Bank N.A. receives from the sale or other disposition of the Tractor shall be credited against the monetary judgment. BMO Bank N.A.'s request for permanent injunctive relief beyond possession awarded above is DENIED. Post-judgment interest shall accrue as provided by 28 U.S.C. § 1961. Post-judgment interest shall accrue as provided by 28 U.S.C. § 1961. IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that Plaintiff is entitled to possession of the Kenworth W900 tractor bearing VIN 1XKWD49X3PR231295. The Clerk of Court is instructed to close this case.
