Because Plaintiff failed to certify an attempt to confer with opposing counsel prior to filing, the Motion is DENIED WITHOUT PREJUDICE. IT IS FURTHER ORDERED that if Plaintiff chooses to refile the motion after conferring, opposing counsel shall have 7 days from the filing date of the motion to respond.
