Order on Motion to Stay
ORDER - IT IS ORDERED: The parties' Joint Motion to Stay Proceedings Pending Mediation (Filing No. 81 ) is granted. All proceedings in this action are stayed until November 16, 2026. The stay encompasses all unexpired deadlines set in the Second Amended Case Progression Order (Filing No. 80 ) and all discovery obligations, including the time to serve responses and objections to outstanding written discovery, to complete document production, to notice or take depositions, to serve expert disclosures, to complete meet-and-confer obligations, and to file any motion to compel or other discovery motion. All hearings, including the planning conference set on September 2, 2026, by telephone before the undersigned magistrate judge, are terminated. On or before November 9, 2026, the parties shall file a joint status report advising the Court: (a) whether mediation occurred and, if so, the date or dates of the mediation session(s) and the name of the mediator; (b) whether this matter has been resolved in whole or in part; (c) if it has not been resolved, whether the parties jointly request a further stay and, if so, for what period and on what grounds; and (d) the parties' proposed amended case progression deadlines if the matter is not resolved. If this matter is resolved, the parties shall comply with Nebraska Civil Rule 41.1, including advising the Court of the mediator's name, the dates of the mediation, and whether the mediation was successful.
