Letter requesting a 14 day extension of the deadline to file an Amended Complaint set in the 6/18/2026 Text Order from SUSAN KEITH. (Filed via ADS) (jal, )
Order on Motion to Amend/Correct
TEXT ORDER: Upon the Court's review of the docket and plaintiff's serial attempts to amend and/or supplement her complaint based on asserted developments in this action and the separate federal and state court actions, see (Dkts. 51 , 53 , 54 , 86 , 90 ), the Court observes that plaintiff's repeated attempts to amend have impeded the orderly progression of this action. The Court, and the parties, have a responsibility "to secure the just, speedy, and inexpensive determination of every action and proceeding." Fed. R. Civ. P. 1. Further, the Court has the authority to limit amendments where justice so requires or where they become harassing, vexatious, or prejudicial. See Fed. R. Civ. P. 15(a)(2). Defendants are entitled to challenge plaintiff's pleading pursuant to Federal Rule of Civil Procedure 12, but cannot do so when the operative pleading remains a moving target. Under these circumstances, the Court will grant plaintiff one final opportunity to file an amended complaint before the Court resolves defendants' Rule 12 challenges. Plaintiff shall file that amended complaint no later than 6/24/26. No extensions to this deadline will be permitted, and no further amendments or supplemental complaints will be permitted until resolution of defendants' Rule 12 motions. Defendants may file motions to dismiss that amended complaint no later than 7/6/26. The Clerk is directed to terminate the pending motions at (Dkts. 53 and 90 ). So Ordered by Magistrate Judge J. Brendan Day on 6/18/2026. (cry)
