MINUTE entry before the Honorable Edmond E. Chang: Video motion hearing held. Counsel for the parties appeared by video. Defendant Young Perry failed to appear. (1.) On defense counsel's motion to withdraw, R. 14, counsel for the Defendants reported that he emailed the video login information to Defendant Perry at three different email addresses. Also, since the date of filing the withdrawal motion he also attempted to call and text Perry with no responses. Given the lack of communication, Attorney J. Matthew Pfeiffer's motion to withdraw as counsel for the Defendants 14 is granted. Defense counsel's final duties are to send Perry a copy of this order and email the courtroom deputy the three last-known emails used to communicate with Perry. (2.) On the motion for default judgment, a docket search of the Defendant's criminal case in S.D. New York, 24 CR 93, revealed that recently (09/24/2024), the Defendant and the government filed a joint motion to continue a status hearing in light of plea discussions and review of discovery. So the Defendant is apparently available to confer and to act on cases, but simply has not done so here. Given the lack of communication and the failure to timely answer or respond to the complaint, the Plaintiff's motion for entry of default judgment 12 is granted against both Defendants in the total amount of $1,066,002.02, jointly and severally.
