ORDER pursuant to 27 Stipulation for Forfeiture. IT IS ORDERED, the Stipulation for Forfeiture is approved. All right, title and interest in the defendant property, approximately $90,000 in United States currency, plus interest and gains, contained in ALTS Plus Fund, LLC, invested by General Investment One LLC, for the benefit of Kevin L McKenzie, is hereby forfeited to and vested in the United States. Kevin L McKenzie knowingly and voluntarily waives all constitutional, legal and equitable defenses to the forfeiture of the defendant, approximately $90,000 in United States currency, plus interest and gains, contained in ALTS Plus Fund, LLC, invested by General Investment One LLC, for the benefit of Kevin L McKenzie, in any proceeding. Kevin L McKenzie agrees to waive any claim or defense under the 8th Amendment to the United States Constitution, including any claim of excessive fine, to the forfeiture of the defendant, approximately $90,000 in United States currency, plus interest and gains, contained in ALTS Plus Fund, LLC, invested by General Investment One LLC, for the benefit of Kevin L McKenzie, by the United States. Kevin L McKenzie shall not be entitled to costs or attorneys' fees, and that the person or persons who made the seizure shall not be liable to suit or judgment on account of such seizure, in accord with 28 USC § 2465. Upon Plaintiff's application to issue a certificate of reasonable cause, having reviewed the record in this case, and being otherwise duly advised, the Court hereby grants a Certificate of Reasonable Cause. The defendant property, approximately $90,000 in United States currency, plus interest and gains, contained in ALTS Plus Fund, LLC, invested by General Investment One LLC, for the benefit of Kevin L McKenzie, forfeited to the United States herein shall be disposed of as follows: $90,000 in U.S. currency to be paid directly to the victim, ABHS, and any remainder to be paid to the Clerk of Court for the District of Arizona.
