PAPERLESS ORDER: The court previously granted Plaintiff leave to file its motion for summary judgment out of time. Upon review of the parties' pending motions for summary judgment at ECF Nos. 76 and 101, the court finds it necessary that the parties conform their summary judgment briefing to Local Rule 105.1(c). Accordingly, it is this 21st day of July 2026, ORDERED that the motions at ECF Nos. 76 and 101 shall be, and are hereby, administratively DENIED without prejudice and with leave to refile. Defendant shall file its renewed motion for partial summary judgment on or before August 7, 2026, whereafter the parties shall proceed with the briefing schedule afforded by the Local Rules. To be clear, the purpose of this order is to bring the parties into compliance with the Local Rules and for the resultant judicial efficiency in resolving the motions; the parties shall not raise arguments not previously asserted in their papers at ECF No. 76 and 101.
