Order on Motion to Deposit Funds
ORDER GRANTING 14 Motion to Deposit Funds-- ORDERED that, within fourteen (14) days of the date of this Order, Penn Mutual shall deposit the disputed funds in the amount of $506,729.46, plus any applicable interest, representing the death benefits payable under the terms of the guaranteed life insurance policy number at issue in this case, into the registry of the Court, by cashiers check payable to Clerk, U.S. District Court. ORDERED that, as soon as practicable after receipt, the Clerk of the Court shall deposit the funds in the Disputed Ownership Fund of the Court Registry Investment System (CRIS), where the funds shall remain pending further order of the Court. It is further, ORDERED that Penn Mutual shall file a notice confirming completion of the deposit within three (3) business days after the Clerk of the Court confirms receipt of the disputed funds. The Court RESERVES RULING on the parties requests to discharge Penn Mutual from any further liability under the disputed life insurance policy, restrain separate proceedings affecting the disputed funds, award Penn Mutual reasonable fees and expenses, or dismiss Penn Mutual from this case with prejudice pending receipt of notice that the required deposit has been completed.
