Order on Motion for Extension of Time of Discovery Cutoff Deadline Order on Motion to Amend/Correct
PAPERLESS ORDER granting in part 89 Plaintiff's Motion to Extend "All Discovery" Deadline and for Amended Scheduling Order ("Motion").
Plaintiff's Motion "seeks an extension of the June 23, 2026 'all discovery' deadline until September 24, 2026, and for the entry of an Amended Order Setting Jury Trial Schedule, Requiring Mediation, and Referring Certain Matters to Magistrate Judge." Mot. at 1. The Court recognizes that the Motion is opposed, and notes that it would not ordinarily grant extensions filed on the eve of the discovery deadline. That said, the Court finds good cause for a brief extension of the discovery deadline.
Accordingly, the 36 Order Setting Jury Trial Schedule, Requiring Mediation, and Referring Certain Matters to Magistrate Judge ("Order") is hereby AMENDED as follows:
July 31, 2026. All discovery, including expert discovery, shall be completed.
August 14, 2026. The parties shall file all pre-trial motions, including motions for summary judgment, and Daubert motions.
September 11, 2026. The parties shall submit a joint pre-trial stipulation, proposed jury instructions and verdict form, or proposed findings of fact and conclusions of law, as applicable, and shall file any motions in limine (other than Daubert motions).
All other dates in the Court's 36 Order remain unaltered, including the calendar call set for October 13, 2026 and the trial date set for October 19, 2026. No further extensions will be permitted absent extenuating circumstances.
