Summary Judgment Relief
MINUTES IN CHAMBERS-COURT ORDER by Judge Percy Anderson. For the foregoing reasons, the Court finds that Defendants are entitled to summary judgment on Plaintiffs' FLSA claims because they are time-barred and because equitable tolling is not warranted. Accordingly, the Court grants Defendants' Motion for Summary Judgment, in part, and denies Plaintiffs' Motion for Equitable Tolling. The Court declines to exercise supplemental jurisdiction over Plaintiffs' state law claim for a writ of mandate and dismisses that claim without prejudice. Pursuant to 28 U.S.C. 1367(d), this Order acts to toll the statute of limitations on the state law claim for a period of thirty (30) days, unless state law provides for a longer tolling period. The Court will issue a Judgment consistent with this Order.
