ORDER SCHEDULING INITIAL CASE MANAGEMENT CONFERENCE: No initial case management conference yet having taken place in this action, it is hereby ORDERED that an initial conference in accordance with Fed. R. Civ. P. 16 will be held on November 10, 2026, at 11:00 a.m. ET in Courtroom 18A, 500 Pearl Street, New York, New York. At the conference, the parties must be prepared to discuss the subjects set forth in Fed. R. Civ. P. 16(b) and (c). It is further ORDERED that counsel shall meet and confer in accordance with Fed. R. Civ. P. 26(f) no later than 21 days before the Initial Case Management Conference. No later than one week (seven (7) calendar days) before the conference, the parties shall file a Report of Rule 26(f) Meeting and Proposed Case Management Plan, via ECF, signed by counsel for each party. A template is available at https://www.nysd.uscourts.gov/hon-sarah-l-cave. To the extent the parties disagree about any portion of the Proposed Case Management Plan, they may set forth their respective proposals for the disputed provision, without argument. SO ORDERED. ORDER: On August 28, 2026, Defendants 1694 Millstone LLC and XLIX Builders LLC (the "Complaint Defendants") filed a third-party complaint against third party DDC Builders LLC ("DDC"). (Dkt. No. 29 (the "Third Party Complaint")). The Complaint Defendants served DDC with the Third Party Complaint on September 3, 2026. (Dkt. No. 42).On September 9, 2026, XLIX Construction LLC, Deuna Holdings LLC, and the Complaint Defendants (together, "Defendants") filed an answer asserting a crossclaim against DDC. (Dkt. No. 37 Para. 32 (the "Crossclaim")). On September 16, 2026, DDC filed an answer to the Third Party Complaint. (Dkt. No. 39 (the "Third Party Answer")). The Third Party Answer does not appear to respond to the Crossclaim. (See generally id.) To date, Defendants have not filed proof that they have served DDC with the Crossclaim.
