(Filing Fee $ 52.00, Receipt Number ANYSDC-32080080) filed by Yves Bouvier, 36 MOTION to Intervene And in Opposition to Application of Yves Bouvier for an Order Pursuant to 28 U.S.C. Section 1782 to Conduct Discovery for Use in Foreign Proceedings, or in the Alternative, for a Stay of the Instant Proceedings or a Protective filed by Jean-Marc Peretti, 19 FIRST MOTION to Intervene and in opposition to the Section 1782 application and in the alternative for a stay and a protective order. filed by Milocci Limited, De Sarthe Contemporary Limited, Pascal de Sarthe. For the foregoing reasons, I respectfully recommend that the unopposed motions to intervene (ECF 19, 36) be GRANTED and that the Application seeking discovery (ECF 1) be GRANTED IN PART, in that subpoenas should be issued to Sotheby's and Christie's for any records between February 1, 2015 and October 3, 2025 of sales of the Artworks by the Discovery Targets. Because some or all the defects in the Application may be curable, I respectfully recommend that Petitioner be permitted to file a renewed application if he can cure the defects identified in this report and recommendation.
