Discovery has not commenced in this case and thus the motion is premature. Further, Ms. Cloutier's stated purpose of entering the subject property in order to inspect it in preparation for sale does not appear sufficient to meet her burden of showing that inspection is for purposes of "obtain[ing] discovery regarding any nonprivileged matter that is relevant to any party's claim or defense and proportional to the needs of the case." Fed. R. Civ. P. 26(b), 34. This motion may be more appropriate for the related state eviction proceedings pursuant to the stipulation of the parties entered therein.
