STIPULATION OF VOLUNTARY DISMISSAL WITH PREJUDICE: IT IS HEREBY STIPULATED AND AGREED by and between plaintiffs Rubin Bros. Produce Corp. ("Rubin") and S. Katzman Produce Inc. ("Katzman") (Rubin and Katzman collectively, "Plaintiffs") and defendants Gramercy Produce Inc. ("Gramercy Produce"), Anthony J. Vivacqua, Sr. ("AJV, Sr.") and Anthony J. Vivacqua, Jr. ("AN, Jr."),(Gramercy, AN, Sr., and AJV, Jr., collectively, "Defendants") (Plaintiffs and Defendants collectively, the "Parties"), pursuant to Fed.R.Civ. P. 41(a)(l )(A)(ii), by and through respective undersigned counsel, as follows: 1.Plaintiffs' claims against the Defendants are hereby voluntarily dismissed in their entirety with prejudice and without costs to either side.
