PAPERLESS ORDER. “Any civil action filed under [the TVRPA] shall be stayed during the pendency of any criminal action arising out of the same occurrence in which the claimant is the victim.” 18 U.S.C. § 1595(b)(1). On April 24, 2026, we stayed this case because the Plaintiff “made a report about her alleged trafficking to law enforcement.” Order Staying Case 103 at 1. On August 26, 2026, the parties filed a Joint Status Report 105 . In that report, the “Plaintiff requests that the Court lift the stay,” while the Defendant Choice Hotels urges us to “maintain the stay until the conclusion of the criminal investigation and any follow-on proceedings.” Id. at 3, 7. Two problems with this. One, the Plaintiff filed a status report asking to reopen the case. See ibid. That won’t do. If the Plaintiff wants to re-open the case, she must file a motion asking for that relief. See S.D. Fla. L. R. 7.1(a)(2) (referring to “relief sought in the motion,” not a status report). Two, only one Defendant, Choice Hotels, participated in the Joint Status Report. We don’t know what position our other two Defendants—Tropical Paradise Resorts or EZ Hospitality—take on lifting the stay. Our Multiple Defendants Order 38 requires the Defendants to jointly file “any responses in opposition to motions filed by the Plaintiff.” Multiple Defendants Order at 2. The Defendants cannot evade this requirement by couching their response in a status report.
